Affiliate Programme Terms and Conditions

1. 1. Programme Overview

The Hair Repair Clinic Affiliate Programme allows approved partners to earn commissions by referring new customers to our platform. As an affiliate, you will receive unique referral links and marketing materials to promote our products and services.

2. 2. Eligibility and Approval

• •You must be at least 18 years old to participate
• •You must be a UK resident or have a UK-based business
• •You must have a legitimate website, blog, social media presence, or professional practice
• •Applications are subject to review and approval at our sole discretion
• •We reserve the right to reject any application without providing a reason
• •Approval may be revoked at any time if you breach these terms

3. 3. Commission Structure

• •Commission rates are set at our discretion and may vary by partner type and performance
• •Standard affiliate commission is typically 10-15% of the net order value (excluding VAT and shipping)
• •Commission is only earned on completed, paid orders that are not subsequently refunded or cancelled
• •Commission rates may be changed with 30 days' written notice
• •Special promotional commission rates may apply during specific campaigns
• •Self-referrals (using your own affiliate link for personal purchases) are not permitted

4. 4. Referral Tracking

• •Referrals are tracked using cookies with a 30-day attribution window
• •The affiliate whose link was clicked most recently before purchase receives the commission
• •We use reasonable efforts to track referrals accurately but cannot guarantee 100% accuracy
• •Technical issues affecting tracking do not entitle you to estimated commissions
• •You must not attempt to manipulate or fraudulently inflate referral tracking

5. 5. Payment Terms

• •Commissions are paid monthly, typically within 14 days of month end
• •A minimum threshold of £50 must be reached before payment is processed
• •Payments are made via bank transfer to UK accounts
• •You are responsible for providing accurate payment details
• •Commissions are held for a 30-day period to account for potential refunds
• •You are responsible for any taxes due on your commission income

6. 6. Promotional Guidelines

• •You must clearly disclose your affiliate relationship in compliance with ASA/CAP guidelines
• •All promotional content must be truthful, accurate, and not misleading
• •You must not make medical claims or guarantee treatment outcomes
• •You must not imply endorsement by medical professionals unless genuinely provided
• •All promotional materials must comply with UK advertising regulations
• •You must use only approved marketing materials and messaging
• •You must not modify our logos or trademarks without written permission

7. 7. Prohibited Activities

• •Spam or unsolicited emails, messages, or communications
• •Bidding on our brand terms or trademarks in paid advertising
• •Cookie stuffing, forced clicks, or fraudulent traffic generation
• •Misleading claims about products, pricing, or availability
• •Impersonating Hair Repair Clinic or our pharmacy partners
• •Promoting to audiences under 18 years of age
• •Using incentivised traffic (cashback, rewards) without prior approval
• •Any illegal, unethical, or harmful promotional methods
• •Creating fake reviews or testimonials
• •Purchasing products with your own affiliate link for resale

8. 8. Intellectual Property

We grant you a limited, non-exclusive, revocable licence to use our approved marketing materials, logos, and trademarks solely for promoting our products as part of this Programme. You may not modify, adapt, or create derivative works from our intellectual property. All rights not expressly granted remain with More On Top Ltd.

9. 9. Confidentiality

You agree to keep confidential any non-public information shared with you as part of the Programme, including commission rates, conversion data, upcoming promotions, and business strategies. This obligation continues after termination of your participation.

10. 10. Data Protection

• •You must comply with UK GDPR and all applicable data protection laws
• •You must not collect, store, or process personal data of referred customers beyond what is strictly necessary
• •You must have appropriate privacy policies for your own platforms
• •You must not share, sell, or transfer any customer data obtained through the Programme

11. 11. Term and Termination

• •Your participation begins upon approval and continues until terminated
• •Either party may terminate with 30 days' written notice
• •We may terminate immediately for breach of these terms or prohibited activities
• •Upon termination, you must cease all promotional activities and remove affiliate links
• •Outstanding commissions above the minimum threshold will be paid within 60 days of termination
• •Commissions below the minimum threshold at termination are forfeited

12. 12. Limitation of Liability

To the fullest extent permitted by law, More On Top Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Programme. Our total liability shall not exceed the total commissions paid to you in the 12 months preceding the claim.

13. 13. Indemnification

You agree to indemnify and hold harmless More On Top Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these terms, your promotional activities, or any violation of applicable laws.

14. 14. Modifications

We reserve the right to modify these Affiliate Terms at any time. Changes will be communicated via email and/or posted on this page. Continued participation after changes constitutes acceptance. Material changes to commission rates will be communicated with 30 days' notice.

15. 15. Relationship of Parties

You are an independent contractor and not an employee, agent, or partner of More On Top Ltd. You have no authority to bind us to any obligations. Nothing in these terms creates a joint venture, partnership, or employment relationship.

16. 16. Governing Law

These Affiliate Terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. 17. Entire Agreement

These Affiliate Terms, together with our general Terms and Conditions and Privacy Policy, constitute the entire agreement between you and More On Top Ltd regarding the Affiliate Programme and supersede any prior agreements or understandings.
